What Banking Lawyers in Islamabad Handle

  • Defending recovery suits filed by banks and financial institutions
  • Applications for leave to defend
  • Suits by customers against banks
  • Objections to sale of mortgaged property
  • Settlements and rescheduling
  • Appeals to the High Court

The Ordinance gives banks a special, faster procedure. Borrowers who ignore the summons often find a decree passed against them within weeks.

The Banking Court Procedure

Leave to defendSection 10The defendant must apply within the time fixed, raising substantial questions

Time limits under the Ordinance are short and strictly applied. We diarise them the day the summons arrives.

Applying for Leave to Defend

What the Application Must Contain

An application for leave to defend must state the amount of finance availed, the amounts repaid with dates, and the amount the defendant disputes, with reasons. A vague denial is not enough.

Common Defences

  • Payments not credited in the statement of account
  • Charges or mark-up beyond the agreement
  • Guarantor’s liability limited or discharged
  • Documents not executed by the defendant
  • Limitation or jurisdiction objections

Mortgaged Property and Section 15

Section 15 allows a financial institution to sell mortgaged property after issuing notices, without a court decree. Our banking advocates examine whether the notices were properly served and whether the sale price and procedure comply with the Ordinance, and file objections where they do not.

Customers Suing Banks

A customer can sue a financial institution in the Banking Court for breach of its obligations. Complaints about service, unauthorised debits or fraud can also be taken to the bank’s complaint unit and then to the Banking Mohtasib Pakistan. Where money was taken through electronic fraud, see our cyber crime lawyers in Islamabad.

Settlement and Rescheduling

Many banking disputes end in a settlement. A settlement should be in writing, signed by an authorised officer of the bank, and recorded before the court if a suit is pending, so that it cannot be ignored later. Our advocates negotiate settlements and check that the bank issues a clearance letter and releases the security.

Dishonoured Cheques in Finance Cases

Banks sometimes add criminal complaints for dishonoured security cheques under section 489-F of the Pakistan Penal Code. Our criminal lawyers handle bail and defence, while the banking team deals with the civil liability.

Why Borrowers Choose Banking Lawyers in Islamabad Early

The single biggest mistake borrowers make is waiting. The Ordinance is designed for speed, and a borrower who first meets an advocate after the leave-to-defend period has expired has very few options left. Early instruction lets us check the statement of account, request missing documents from the bank and prepare a proper application.

Documents Banking Lawyers in Islamabad Ask For

  • Finance agreement, sanction letter and any rescheduling letters
  • Statement of account supplied by the bank
  • Your own record of repayments, receipts and bank transfers
  • Mortgage deed, guarantee and any security cheques
  • All notices received from the bank

Reading the Statement of Account

Banks are required to file a statement of account with the suit. Errors in mark-up, penal charges, insurance and unexplained debits are common, and identifying them is often the strongest part of the defence.

Guarantors and Family Members Sued With Banking Lawyers in Islamabad

Banks often sue guarantors, including relatives who signed without understanding the risk. A guarantor’s liability depends on the terms of the guarantee: its limit, whether it was continuing, and whether the bank changed the finance without the guarantor’s consent. Where a borrower has died, heirs are liable only to the extent of the assets they inherited, not personally.

Personal Guarantees by Directors

Directors of companies frequently sign personal guarantees. We examine whether the guarantee covers the facility sued on and whether any discharge has occurred.

Our Approach for Guarantors

Our banking advocates separate the guarantor’s position from the borrower’s, so that a guarantor is not simply swept into the borrower’s defence.

Execution of Banking Decrees and How Banking Lawyers in Islamabad Respond

Once a decree is passed, the bank applies for execution: attachment of accounts, sale of mortgaged property or, in some cases, arrest. A judgment debtor can still object to the execution where the amount is wrong, the property is not liable, or a settlement has been reached. We file objections promptly and, where a settlement is realistic, negotiate it before an auction date is fixed.

An appeal under section 22 does not automatically stay execution; a stay must be sought from the High Court with the appeal.

Islamic Banking Disputes and Banking Lawyers in Islamabad

Islamic banking facilities, such as Murabaha, Ijarah and Diminishing Musharakah, are also recovered under the Ordinance. The defence often turns on whether the bank followed the structure it documented: whether goods were actually purchased and sold in a Murabaha, or whether rentals and ownership were treated correctly in an Ijarah. We read the transaction documents against the claim.

Car and house finance disputes frequently involve insurance, early settlement charges and repossession. Repossession of a vehicle must follow the agreement and the law; we advise where a vehicle has been taken without proper notice.

Credit Reports and Clearance After Settlement

After a finance is settled or a decree satisfied, the bank should report the account as closed to the credit bureau and issue a clearance letter and release of security. Borrowers often forget this step and find years later that the record still shows default. We ask for the clearance and the return of title documents as part of every settlement.

Lenders and Private Lenders

We also act for lenders. Private loans between individuals are not covered by the Ordinance and are recovered through ordinary civil suits; see our civil lawyers in Islamabad.
