PECA was amended in 2025. The exact offence, punishment and procedure depend on the facts and the current text, which we check for each case.

The NCCIA and Where Complaints Go

The National Cyber Crime Investigation Agency was established under PECA and has taken over the cybercrime functions previously performed by the FIA Cyber Crime Wing. Complaints are lodged with the NCCIA, which investigates and, where an offence is made out, registers a case and submits it to the court.

Our cyber crime advocates draft the complaint so that it identifies the offence, the accounts or numbers involved, and the evidence, which makes it harder for a complaint to be closed without action.

Preserving Evidence

  • Take screenshots showing the date, time, profile link and phone number
  • Save the URL of each post or profile
  • Do not delete messages, chats or accounts
  • Keep bank statements and transaction IDs in fraud cases
  • Write a short timeline of events while it is fresh

Evidence that is deleted or altered is often impossible to recover. Preserve it first, then take advice.

Blackmail and Image Abuse

Do Not Pay

Paying a blackmailer rarely ends the threats. Keep the messages and report.

Urgent Steps

Report the account to the platform, preserve the evidence and file a complaint. Our advocates also advise on requests to remove unlawful content through the authority designated under PECA as amended.

Confidentiality

Victims, especially women, often fear publicity. We handle these cases discreetly and explain what the complaint process involves before anything is filed.

Defence for People Accused Under PECA

Being named in a PECA complaint does not mean guilt. Our advocates examine whether the content falls within the offence charged, whether the account is actually the accused’s, and whether the complaint is a counter-blast in a family or business dispute. We apply for pre-arrest or post-arrest bail where needed and defend at trial. See our criminal lawyers in Islamabad.

Electronic Fraud and Online Banking Scams

Where money has been taken through a fake call, phishing link or SIM swap, report to the bank immediately so the transaction can be traced, then file a complaint. Our banking lawyers in Islamabad advise on complaints against the bank where it failed to act.

Cyber Crime Lawyers in Islamabad for Family Disputes

Cyber complaints often arise in marriages that have broken down: hacked accounts, private photos shared, or fake profiles made to defame a spouse. These cases run alongside family proceedings, so our family and criminal teams co-ordinate. See our divorce lawyers in Islamabad.

How Cyber Crime Lawyers in Islamabad Draft a Complaint

A strong complaint is specific. It names the platform and account, gives the profile links and phone numbers, sets out the dates of each incident, identifies the PECA provision that appears to apply, and attaches the evidence in order. Vague complaints are easily closed.

  • Complainant’s CNIC and contact details
  • Description of each incident in date order
  • Screenshots with URLs and timestamps
  • Details of any money transferred
  • Any information about the suspect’s identity

Following Up With the Agency

The advocates follow the complaint with the investigating officer and, where the agency does not act within a reasonable time, advise on remedies before the court.

Businesses and Cyber Crime Lawyers in Islamabad

Companies face data theft by former employees, fake websites using their brand, email compromise and online defamation. PECA offences can be complained of by a company as well as an individual, alongside civil remedies for breach of confidence or contract. We advise businesses on preserving logs and evidence, and on the complaint and civil routes together.

Data Held by Employees

Where an employee leaves with client data, a prompt legal notice, an injunction application and a PECA complaint may all be appropriate.

Evidence Standards in Cyber Cases

Courts look at how electronic evidence was collected and whether it is reliable. Screenshots are a starting point, but the agency may need to obtain records from platforms or telecom companies. Keeping the original device and not altering files helps the evidence stand up at trial. The Qanun-e-Shahadat Order 1984 allows evidence generated by modern devices to be admitted, subject to proof.

Bail and Procedure in PECA Cases

Whether an offence is cognizable and bailable depends on the section charged and the current text of PECA as amended. Where an accused is arrested, our advocates apply for post-arrest bail and, where arrest is threatened, for pre-arrest bail. The court considers whether the offence is made out on the record, the evidence available and the risk of tampering.

Statements to the Agency

A person called by the investigating agency should take advice before attending, and should take copies of any documents they intend to rely on.

Where Cyber Crime Lawyers in Islamabad Meet Clients

Most cyber clients first contact us on WhatsApp, often late at night when a threat arrives. We reply, explain the immediate steps and arrange a meeting at the G-9 Markaz office or a video call. Evidence can be shared securely on WhatsApp, and we keep it confidential.

Cyber Crime Lawyers in Islamabad and Online Defamation

False allegations posted online can damage a person or business. Depending on the facts, remedies may include a complaint under PECA, a civil suit for defamation and damages under the Defamation Ordinance 2002, and requests to the platform for removal. We advise on the route that best protects reputation without amplifying the false statement.

Children and Online Safety

Where a child is targeted online, parents should preserve the evidence, stop contact with the account and report it at once. Offences involving children are treated with particular seriousness. We advise parents discreetly and co-ordinate with the agency.

Hacked Accounts and Impersonation

Where an email, WhatsApp or social-media account has been taken over, recover it through the platform’s official process first, enable two-factor authentication, and tell contacts not to respond to requests from the account. Then preserve evidence of what the intruder did. A complaint can follow under the PECA provisions on unauthorised access and identity misuse.

  • Recover the account through the official platform process
  • Change passwords and enable two-factor authentication
  • Warn contacts about messages sent in your name
  • Screenshot any posts or messages sent by the intruder

Fraudulent Investment and Job Offers

Online investment schemes, fake job offers requiring fees and fraudulent online shops are frequent. Victims should stop payments, report to the bank and preserve the chat and payment records. Recovery of money is not guaranteed, but early reporting improves the chance that accounts can be traced and frozen.

Women Facing Online Harassment

Women are disproportionately targeted by online harassment, fake profiles and threats to share private images. Many hesitate to complain for fear of family reaction or publicity. Our advocates explain the complaint process privately, help preserve evidence without the victim having to show it to relatives, and can co-ordinate with family-court proceedings where the harasser is a spouse or former spouse.

Immediate Steps for Victims

  • Do not engage with or pay the harasser
  • Preserve every message and profile link
  • Report the account to the platform
  • Seek advice before filing a complaint

Keeping Your Accounts Secure

Prevention is easier than prosecution. Use strong, separate passwords, enable two-factor authentication, never share one-time codes, review which devices are logged in to your accounts, and be careful about sharing private images even with people you trust. If a phone is lost, change passwords from another device at once and inform the mobile operator so that the SIM can be blocked.

How Our Advocates Charge

We read the evidence first, explain whether an offence is likely made out and confirm the fee in writing. We do not promise arrests, removal of content by a date, or any result; investigating agencies and courts decide.
