Divorce Lawyers in Islamabad at our Laraib Plaza, G-9 Markaz office advise husbands and wives on ending a marriage with the least damage: the talaq or mutual-divorce procedure, a written settlement of dower, maintenance and dowry, and arrangements for the children. Kashif Mumtaz and Muhammad Usman Bhatti, Advocates High Court, conduct the cases, and Qanoon Group advocates have practised family law since 1985.

What Divorce Lawyers in Islamabad Do for You

Most people who contact us do not need a long court case. They need the right procedure, a fair written settlement and protection for the children. Our role is to get those three things right, and to go to court only when the other side leaves no choice.

  • Advise on the correct route: talaq, delegated divorce, mubarat, khula or dissolution
  • Draft the papers and handle the Union Council file
  • Negotiate dower, maintenance, dowry articles and housing
  • Agree or litigate custody and visitation
  • Defend or bring claims in the Family Court

Advice for Husbands

Before You Pronounce Talaq

Talk to an advocate first. Once notice goes to the Union Council, the ninety days start, the deferred dower becomes payable when the talaq is effective, and the wife’s claims for iddat maintenance arise. Planning the money side in advance avoids a second dispute.

Giving Notice Properly

Section 7 of the Muslim Family Laws Ordinance 1961 requires written notice to the Union Council Chairman and a copy to the wife. Our divorce papers page explains each document.

Second Marriage

A husband who wishes to remarry while the first marriage subsists needs the Arbitration Council’s permission under section 6. Marrying without it exposes him to prosecution and gives the first wife a ground for dissolution.

Advice for Wives From Divorce Lawyers in Islamabad

A wife has several routes, and the best one depends on the Nikah Nama. If column 18 delegates the right of divorce, she can act herself through the Union Council. Otherwise she can file for khula, or for dissolution on a ground under the Dissolution of Muslim Marriages Act 1939, which can protect her dower.

Our khula lawyers in Islamabad explain the court route in detail. Whatever the route, we file the claims for dower, maintenance and dowry articles alongside it.

Mutual Divorce and Written Settlements

Where both spouses accept that the marriage is over, a mutual divorce (mubarat) with a signed settlement is usually the quickest and least expensive route. The Union Council notice procedure is still followed so the divorce can be certified.

Settlement pointWhat to recordWhy it matters
DowerAmount paid, amount remaining, date of paymentPrevents a later dower suit
Iddat maintenanceAmount and how it is paidAvoids a maintenance claim
Dowry articlesList of items returned and receiptAvoids a recovery suit
ChildrenResidence, meetings, maintenance, schoolingCan be made a court order if needed
HousingWho stays where and until whenPrevents harassment complaints

A settlement about children is not binding on the court, which always decides on the child’s welfare, but a sensible agreement is usually approved.

When the Case Goes to the Family Court

Where settlement fails, the Family Court under the Family Courts Act 1964 hears claims for dissolution, dower, maintenance, dowry articles, custody and guardianship. The court first tries reconciliation under section 10. Our divorce advocates prepare the evidence, the witness list and the documents so the trial runs on time.

Divorce settlement meeting with divorce lawyers in Islamabad

Interim maintenance can be ordered early in the case under section 17A. Appeals lie under section 14, and Fiaz Ahmed Khakh, Advocate Supreme Court, handles appellate work.

Children Come First for Our Divorce Lawyers in Islamabad

Custody and visitation are decided by the Guardian Judge on the welfare of the child under the Guardians and Wards Act 1890. We encourage parents to agree a parenting plan, and where they cannot, we apply for interim custody and a meeting schedule at the start. See our child custody lawyers in Islamabad.

Overseas Spouses and Divorce Lawyers in Islamabad

Husbands and wives abroad can instruct us by WhatsApp and video call. Papers are signed abroad, attested where needed, and filed here. A foreign divorce does not automatically update the Union Council and NADRA records, so we check the Pakistani position before either spouse remarries.

Contested Cases Handled by Divorce Lawyers in Islamabad

Some divorces are bitterly contested: dower is disputed, dowry articles are withheld, custody is fought, and criminal complaints are filed by one side against the other. In these cases the family and criminal sides must be co-ordinated so that a step in one does not damage the other.

Restitution of Conjugal Rights

A husband sometimes files for restitution of conjugal rights in response to a khula suit. The suits are usually heard together, and the wife’s reasons for living apart are examined.

Criminal Complaints in Family Disputes

Complaints of harassment, theft of dowry or cyber offences are sometimes genuine and sometimes tactical. We advise on both sides; see our cyber crime lawyers page.

Documents Divorce Lawyers in Islamabad Ask For

  • Nikah Nama and both CNICs
  • Children’s B-Forms
  • Proof of dower paid or unpaid
  • List of dowry articles with any receipts or photographs
  • Messages or notices exchanged between the spouses
  • Any earlier court orders or Union Council papers

With these documents our advocates can give firm advice at the first meeting rather than general guidance.

Timelines You Can Expect

A talaq becomes effective ninety days after the Union Council receives notice. A khula suit depends on service on the husband and the court list. Contested money and custody claims take longer. We explain the stages honestly at the start rather than promising a date.

Protecting Your Privacy

Family cases involve personal information. We keep files confidential, share documents only with the client, and advise on keeping social-media activity careful while the case is pending, because posts are sometimes produced as evidence.

Why Clients Instruct Our Islamabad Office

Clients instruct us on divorce because the work is done by named advocates rather than agents, the documents are read before any advice is given, and the fee is confirmed in writing before work starts. Qanoon Group advocates have practised since 1985, and appellate work is handled by Fiaz Ahmed Khakh, Advocate Supreme Court.

  • Advice from an enrolled advocate, not a clerk
  • Written fee confirmation, with official charges shown separately
  • WhatsApp updates after every step
  • Confidential handling of personal and family information

How Our Divorce Advocates Charge and Report

We read your papers before advising and confirm the fee in writing before work starts. Court fees and government charges are shown separately. You receive a WhatsApp update after every hearing. No honest advocate can promise a result or a date, and we do not.
