Two Routes to a Succession Certificate in Islamabad
| Route | When it fits | Law | Issued by |
|---|---|---|---|
| NADRA Succession Facilitation Unit | All legal heirs agree and are identified in NADRA records | Letters of Administration and Succession Certificates Act 2020 | NADRA unit, under the Act |
| Civil court | Heirs dispute shares, are missing from records, or the unit cannot proceed | Succession Act 1925, including section 372 | Court of competent jurisdiction |
The NADRA route is usually faster for straightforward families. Where any heir objects, or the family tree is unclear, the matter belongs in court.
The NADRA Route Under the 2020 Act
- All legal heirs appear, or are represented, at the NADRA Succession Facilitation Unit
- Identity and family relationships are verified from NADRA records
- The deceased’s movable and immovable assets are declared
- Heirs record their consent to the distribution
- A public notice period allows objections
- The certificate or letters of administration are issued if no objection is received
If an objection is received or the records do not match, the unit refers the matter for the court route. We prepare the family tree and asset list so that the application is complete.
The Court Route
Application Under Section 372
An application under section 372 of the Succession Act 1925 sets out the date of death, the heirs, the debts and securities concerned and the applicant’s right. The court publishes notice and hears objections.
Disputed Heirs
Where a person’s status as heir is disputed, for example a second wife or a child whose parentage is denied, the court decides it on evidence.
Security
The court may require the applicant to give security before the certificate is issued.
Documents for a Succession Certificate in Islamabad
- Death certificate of the deceased
- Family registration certificate from NADRA
- CNICs of all heirs; B-Forms of minors
- Bank account details, share certificates, vehicle and property papers
- Nikah Nama where the widow’s status must be shown
- Guardianship order where a minor heir’s share is involved
Where a minor is among the heirs, a guardianship order may also be needed to deal with the minor’s share.
Shares Under Muslim Inheritance Law
The certificate does not create shares; it records and gives effect to them. Muslim heirs inherit according to the fixed shares of Islamic law as applied in Pakistan. Section 4 of the Muslim Family Laws Ordinance 1961 provides that the children of a predeceased son or daughter take the share their parent would have taken. We prepare the share calculation with the family tree.
After the Certificate
Banks release balances and the CDA, societies and revenue offices transfer property on production of the certificate and the documents they ask for. Land in the revenue record needs a mutation of inheritance as well. Our property lawyers in Islamabad handle transfers and partition where heirs cannot agree how to divide property.

Overseas Heirs and a Succession Certificate in Islamabad
Heirs living abroad can take part through a power of attorney attested at the Pakistani mission. Where the NADRA unit requires personal verification, we confirm in advance how it can be done. See our overseas Pakistanis page.
Bank, Shares and Vehicles: Using a Succession Certificate in Islamabad
Each institution has its own procedure for acting on the certificate. Banks require the original or a certified copy and the heirs’ CNICs; share registrars require transfer forms; the Excise and Taxation office transfers vehicles. We prepare a covering set of documents for each institution so that the heirs do not have to make repeated visits.
| Asset | Where it is transferred | Usual documents |
|---|---|---|
| Bank balance | Bank branch | Certificate, heirs’ CNICs, indemnity |
| Shares | Company or share registrar | Certificate, transfer forms |
| Vehicle | Excise and Taxation office | Certificate, registration book |
| CDA or society property | CDA or society office | Certificate or letters of administration, transfer application |
Disputes Between Heirs Over a Succession Certificate in Islamabad
Disputes arise when an heir is left out, when a second wife or her children are not acknowledged, or when one heir has been managing the property and refuses to account. The court hears the objection and decides on evidence. Where possession of property is disputed, a partition suit may also be needed. Our civil lawyers handle these suits.
Minors and Widows Among the Heirs
A widow is entitled to her share and, where unpaid, to her dower as a debt of the estate. Minor heirs’ shares are usually protected by a guardianship order and deposit in a profit-bearing account. Our advocates make sure the certificate application and the guardianship application are consistent.
Costs and Charges for a Succession Certificate in Islamabad
Charges include the official fee for the NADRA or court route and, in the court route, court fee calculated on the value of the assets covered. Our professional fee is confirmed in writing. We list the assets carefully because the fee and the scope of the certificate both depend on what is declared.
Debts of the Deceased
The estate pays the deceased’s debts, funeral expenses and any unpaid dower of the widow before the heirs take their shares. Creditors may object to the certificate. We identify known debts at the outset so the application is accurate.
Why Clients Instruct Our Islamabad Office
Clients instruct us on succession and inheritance because the work is done by named advocates rather than agents, the documents are read before any advice is given, and the fee is confirmed in writing before work starts. Qanoon Group advocates have practised since 1985, and appellate work is handled by Fiaz Ahmed Khakh, Advocate Supreme Court.
- Advice from an enrolled advocate, not a clerk
- Written fee confirmation, with official charges shown separately
- WhatsApp updates after every step
- Confidential handling of personal and family information
Keeping the Estate Papers Together
Keep the certificate, the family tree and the asset list together; later transfers will need them again.
Common Delays and How to Avoid Them
- An heir missing from the family registration certificate
- Spelling differences between CNICs and bank records
- A second marriage not recorded with NADRA
- Assets not declared in the first application
- A minor heir without a guardian
Checking these points first is the quickest way to obtain a succession certificate without a second application.
